LITTLE MIRACLE BABY

TERMS AND CONDITIONS

Website: littlemiraclebaby.co.za
Last updated: September 2026

1. INTRODUCTION

These Terms and Conditions govern the use of the Little Miracle Baby website and the purchase of products through our online store.

By placing an order through our website, you acknowledge that you have read and understood these Terms and Conditions.

Little Miracle Baby reserves the right to update these Terms and Conditions from time to time. The version applicable to your order will be the version in effect when your order is placed.

Nothing in these Terms and Conditions is intended to exclude, restrict or limit any consumer right that cannot lawfully be excluded or limited under applicable South African law.

2. OUR PRODUCTS

Little Miracle Baby sells baby clothing, baby accessories and other baby-related products through our online store.

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and specifications are accurate. However, minor variations in colour, appearance, packaging or presentation may occur due to photography, lighting, manufacturing differences and individual device screens.

Product images are for illustrative purposes where indicated.

3. PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to your shopping cart does not guarantee that the product will remain available until payment has been completed.

If a product becomes unavailable after an order has been placed and Little Miracle Baby cannot fulfil the order, we will notify you and arrange an appropriate remedy in accordance with applicable law, including a refund where required.

4. PRICES

All prices displayed on the website are in South African Rand (ZAR).

We make reasonable efforts to ensure that prices are accurate. If an obvious pricing or listing error occurs, we reserve the right to contact the customer before processing the order further.

Where an incorrect price has resulted from a genuine and obvious error, Little Miracle Baby may cancel the affected order and refund any payment received, subject to applicable law.

Delivery charges are displayed separately where applicable.

5. ORDERS

An order is submitted when the customer completes the checkout process and submits the order.

Receipt of an automated order confirmation does not necessarily mean that the order has been finally accepted if payment has not been successfully received or if there is an issue affecting fulfilment.

We reserve the right to refuse or cancel an order where permitted by law, including where there is suspected fraud, payment failure, an obvious pricing error, stock unavailability or other legitimate fulfilment issue.

Where an order is cancelled after payment has been received, any refund will be handled in accordance with applicable law.

6. PAYMENT

Payment must be successfully completed through the payment options made available on the website unless an alternative payment arrangement has been expressly agreed with Little Miracle Baby.

Orders will generally only be processed once payment has been successfully confirmed.

Little Miracle Baby does not store customers' full card details. Online card payments are processed through the applicable third-party payment provider.

The customer is responsible for providing accurate payment and billing information.

7. DELIVERY

We currently deliver within South Africa to the delivery areas supported by our shipping service.

Available delivery methods and applicable delivery charges will be displayed during checkout.

The customer is responsible for providing a complete and accurate delivery address, telephone number and other information required for delivery.

Little Miracle Baby is not responsible for delays caused by:

  • Incorrect or incomplete delivery information supplied by the customer;

  • The customer being unavailable to receive the parcel;

  • Courier delays or operational problems;

  • Weather, strikes, public disturbances or other events outside our reasonable control; or

  • Circumstances beyond our reasonable control.

If a parcel is returned to Little Miracle Baby because the customer supplied an incorrect address or repeatedly failed to accept delivery, additional delivery charges may apply before the parcel is resent.

We will nevertheless comply with any delivery rights and remedies that apply under South African law.

8. DELIVERY TIMES

Estimated delivery times are provided as a guide and may vary depending on the destination, courier and circumstances affecting delivery.

Where a specific delivery period has been agreed, applicable statutory rights relating to delivery remain unaffected.

If Little Miracle Baby cannot fulfil an order within the applicable agreed or statutory period, the customer will have the rights provided by applicable law.

9. INSPECTION OF GOODS

Customers should inspect their order as soon as reasonably possible after delivery.

If the product is damaged, incorrect, incomplete or appears defective, please contact us as soon as possible and provide:

  • Your order number;

  • A description of the problem;

  • Photographs of the product and packaging where relevant; and

  • Any other information reasonably required to investigate the issue.

Customers should not dispose of or substantially alter a product that is the subject of a return or quality complaint until the matter has been resolved, unless otherwise agreed.

10. RETURNS, EXCHANGES AND REFUNDS

Little Miracle Baby respects all applicable consumer rights under South African law.

Where legislation gives a customer a right to cancel, return, repair, replace or obtain a refund, those rights will apply regardless of anything else stated in these Terms and Conditions.

For certain online transactions, the ECT Act provides a statutory seven-day cooling-off right for goods, subject to the Act and its exceptions.

Where a customer exercises a statutory cooling-off right, the applicable requirements regarding returning the goods and refunding payment will apply.

Additional return or exchange options offered voluntarily by Little Miracle Baby will be subject to the conditions communicated with the relevant product or order.

11. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If you receive a product that is defective, damaged, incomplete or materially different from what you ordered, please contact Little Miracle Baby.

We will assess the matter and provide the remedy required under applicable consumer law, which may include repair, replacement or refund depending on the circumstances.

Nothing in these Terms and Conditions limits a consumer's statutory rights regarding defective or unsafe goods.

12. CHANGE-OF-MIND RETURNS

Where a customer requests a return simply because they have changed their mind, the return will be dealt with according to the applicable statutory rights and any additional return policy voluntarily offered by Little Miracle Baby.

Where the law permits us to impose reasonable return conditions, these may include that goods are returned safely and that applicable return costs are borne by the customer.

Any statutory cooling-off rights will remain unaffected.

13. SALE ITEMS AND PROMOTIONAL PRODUCTS

Sale prices, promotional offers and discounts may be subject to specific conditions stated with the relevant promotion.

A promotion does not remove or reduce any statutory consumer rights.

14. BABY PRODUCTS AND PRODUCT USE

Customers are responsible for using products in accordance with any instructions, warnings, age recommendations, size information and manufacturer guidance supplied with the product.

Parents, guardians and caregivers remain responsible for supervising babies and children when products are being used.

Little Miracle Baby should not be relied upon as a substitute for professional medical, safety or childcare advice.

Where a manufacturer provides safety instructions or warnings, customers should follow them carefully.

15. PERSONALISED PRODUCTS

Where Little Miracle Baby offers personalised or customised products, the customer is responsible for checking that names, spelling, sizes, colours and other information supplied during ordering are correct.

Where applicable law permits, personalised products may be subject to different return conditions because they have been made according to the customer's specifications.

This clause does not limit any statutory consumer rights.

16. CUSTOMER INFORMATION

Customers must provide accurate and up-to-date information when placing an order.

Little Miracle Baby is not responsible for problems caused directly by inaccurate information supplied by the customer, including an incorrect delivery address or contact number.

17. WEBSITE CONTENT

We make reasonable efforts to ensure that information on the website is accurate and current.

However, we do not guarantee that the website will always be free from errors, interruptions or technical problems.

We may correct errors, update information, change product availability or make improvements to the website without prior notice.

18. INTELLECTUAL PROPERTY

Unless otherwise stated, the content on the Little Miracle Baby website, including logos, photographs, product descriptions, graphics, text and branding, belongs to Little Miracle Baby or is used with permission.

Content may not be copied, reproduced, modified, distributed or commercially exploited without written permission, except where permitted by law.

19. THIRD-PARTY SERVICE PROVIDERS

Little Miracle Baby may use third-party service providers for services including:

  • Online payment processing;

  • Website hosting;

  • Courier and delivery services;

  • Communication services; and

  • Other services necessary to operate the online store.

Those providers may have their own terms and privacy policies.

20. LIMITATION OF LIABILITY

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by South African law.

To the extent permitted by law, Little Miracle Baby will not be responsible for indirect or consequential loss arising from matters outside our reasonable control.

Nothing in this clause limits a customer's statutory rights relating to defective, unsafe or unsuitable goods.

21. EVENTS OUTSIDE OUR CONTROL

Little Miracle Baby will not be responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, strikes, civil unrest, government restrictions, courier disruptions, power or telecommunications failures, or other events of force majeure.

Where such an event occurs, we will take reasonable steps to minimise the effect on customers.

22. PRIVACY

Personal information supplied by customers will be handled in accordance with our Privacy Policy and applicable South African data-protection laws.

We will use customer information for purposes reasonably necessary to process orders, arrange delivery, communicate with customers, provide customer service and comply with legal obligations.

23. CUSTOMER COMPLAINTS

If you have a complaint, please contact Little Miracle Baby using the contact details published on our website.

We will make reasonable efforts to investigate and resolve complaints promptly and fairly.

24. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Nothing in these Terms and Conditions prevents a consumer from exercising any right or remedy available under applicable South African consumer-protection legislation.

25. ENTIRE AGREEMENT

These Terms and Conditions, together with the information displayed on the relevant product page, checkout page, applicable policies and any order-specific terms agreed with the customer, form the basis of the agreement relating to an online purchase.

If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
